Golden Valley man sentenced for sex crime
Nigel Raymond Brown, 29, of Golden Valley, pleaded guilty Aug. 24 and was sentenced Oct. 29 in Beltrami County District Court for serious felony third-degree criminal sexual conduct with a victim between the ages of 13-15.
Judge Paul Benshoof sentenced Brown to 36 months in prison, which was stayed for 15 years. Conditional release after confinement has been set at 10 years. He must serve 59 days in jail, with credit for 121 days served and sign a sex offender registration form before being released from custody; serve15 years of supervised probation; register as a predatory offender; submit a DNA sample; remain law-abiding; restitution reserved; not possess or use any pornographic or sexually explicit material; not have access to the use of Internet without approval; not have any contact with women younger than16; have no contact with victims; follow all instructions of probation; attend a sex offender program and pay a fine of $75.
According to the criminal complaint, in January, a 14-year-old girl introduced her 13-year-old girlfriend to Brown through an Internet site. Brown and the 13-year-old began communicating online and arranged to meet near the girl's Cass Lake home in May. At that time, they had sexual intercourse in Brown's car. In June, Brown returned, and he and the 13-year-old again engaged in sex at two Bemidji motels.
The mother of the 14-year-old found out about the sexual activity through her daughter and reported the situation.
Bemidji Police officers went to a Bemidji motel where Brown was staying, knocked on Brown's door and were admitted to the room. He said the girl in the room was his niece, but there was significant evidence of sexual activity in the room, including used and unused condoms.
Brown said he knew the girl's age and that having sexual intercourse with her was wrong.
