Court report: Sentencings for March 31, April 4 and 7

The following cases were heard March 31 by Beltrami District Judge Paul T. Benshoof:

Rebecca Jean Johnson, 38, of Bemidji was granted a stay of adjudication for driving after cancellation. Johnson has been placed on two years court probation upon successful completion of which will result in a dismissal of the charge.

The following cases were heard April 4 by Beltrami District Judge Paul T. Benshoof:

Jacob Andrew Young, 22, of Walker was sentenced for felony second-degree assault with a dangerous weapon to 46 months in the Minnesota Correctional Facility in St. Cloud. Young must pay a $1,000 fine.

Deavion Ladell Beasley, Sr., 20, of Bemidji was sentenced for domestic assault to 365 days in the Beltrami County Jail of which 363 days are stayed for two years. Beasley must serve two days. He has been placed on two years supervised probation and must pay a $500 fine.

The following cases were heard April 7 by Beltrami District Judge John G. Melbye:

Rebecca Jo Ausk, 32, of Cass Lake was sentenced for third-degree burglary and fourth-degree assault to 107 days in the Beltrami County Jail for the burglary charge of which she has been credited 107 days time served. She has been placed on five years supervised probation upon successful completion of which will result in a misdemeanor conviction. Ausk must pay a $1,000 fine for the burglary charge which may be done by way of community service.

Richard Lawrence Butcher, Jr., 40, of Cass Lake was sentenced for felony terroristic threats to 18 months in the Minnesota Correctional Facility in St. Cloud which has been stayed for five years. Butcher must serve 60 days in the Beltrami County Jail and may do so on work release if eligible. He has been credited for 10 days time served. Butcher has been placed on five years supervised probation and must pay a $1,500 fine of which $1,000 is stayed for two years. Butcher may pay his fine through community service.

Martin Erwin Ubert, 58, of Bemidji was sentenced for felony criminal vehicular homicide or operation/driver who causes accident leaves scene to 13 months in the Minnesota Correctional Facility in St. Cloud which has been stayed for four years. Ubert must serve 213 days in the Beltrami County Jail and has been credited for 213 days time served. He has been placed on four years supervised probation and must pay a $1,500 fine plus $404 in restitution.

Perry Lee Torgerson, 39, of Sauk Rapids was sentenced for second-degree DWI to 365 days in the Beltrami County Jail of which 335 days are stayed for four years. Torgerson must serve 30 days and may do so on work release and in a different county if at no cost to Beltrami County. He has been credited for three days time served. Torgerson has been placed on four years court probation and must pay a $750 fine which may be done by way of community service.

Toby Allen Losh, II, 34, of Cass Lake was sentenced for felony theft of a motor vehicle to 30 days in the Beltrami County Jail which may be done on work release if eligible. Losh has been credited for nine days time served. He has been placed on five years supervised probation and must pay a $1,000 fine which may be done by way of community service.

William Taylor Tanner, 30, of Blackduck was sentenced for felony fifth-degree drug possession and child endangerment to 19 months in the Minnesota Correctional Facility in St. Cloud which has been stayed for five years for the drug charge and 365 days in the Beltrami County Jail of which 320 days are stayed for two years on the child endangerment charge. He must serve 45 days in the Beltrami County Jail and may do so on work release if eligible. Tanner has been credited for two days time served. He has been placed on five years supervised probation and must pay a $1,000 fine which may be done through community service for the drug charge. Tanner has been placed on two years supervised probation and must pay a $250 fine for the child endangerment charge, he may pay the fine through community service.

Sylvia Rose White, 27, of Bemidji was sentenced for felony third-degree aiding and abetting assault to 15 months in the Minnesota Correctional Facility in Shakopee which has been stayed for five years. White has been placed on five years supervised probation and must pay a $1,500 fine of which $1,000 is stayed for five years. She may pay her fine by way of community service. White was also sentenced for third-degree felony burglary to 18 months in the Minnesota Correctional Facility in Shakopee which is stayed for five years. She has been placed on five years supervised probation and must pay a $1,500 fine of which $500 is stayed. White may pay her fine by community service. She has been ordered to pay $2,384 in restitution.

Michael James Ostlund, 43, of Redby was sentenced for driving after cancellation to 365 days in the Beltrami County Jail of which 350 days are stayed for two years. Ostlund must serve 15 days. He has been placed on two years court probation and must pay a $500 fine which may be done by way of community service.

Joe Allen Risland, 35, of Bemidji was granted a stay of adjudication for driving after cancellation. Risland has been placed on one year court probation upon successful completion of which will result in a dismissal of the charge.

Daniel Wayne Jourdain, Sr., 29, of Bemidji was sentenced for felony fifth-degree possession of methamphetamine and second-degree DWI to 15 months in the Minnesota Correctional Facility in St. Cloud which was stayed for five years for the drug charge. He was sentenced to and credited with 162 days served in the Beltrami County Jail. Jourdain has been placed on five years supervised probation and must pay a $1,000 fine which may be done through community service. Jourdain has been sentenced to 365 days in the Beltrami County jail which has been stayed for four years on the DWI charge. He has been placed on four years supervised probation and must pay a $50 fine which may be done through community service.

Donna Jean Staples, 55, of Bemidji was sentenced for felony fifth-degree possession of Alprazolam and theft to 12 months and one day in the Minnesota Correctional Facility in Shakopee which has been stayed for 10 years on the drug charge. She must serve 180 days in the Beltrami County Jail and has been credited with 62 days time served. Staples has been placed on 10 years supervised probation and must pay a $1,000 fine which may be done through community service. Staples has been sentenced to 90 days in the Beltrami County Jail for the theft charge.

Lance David Week, 27, of Bemidji was sentenced for three counts of felony financial transaction card fraud. Week was sentenced to 12 months and one day at the Minnesota Correctional Facility in St. Cloud for the first two counts and he was sentenced to 13 months in the Minnesota Correctional Facility in St. Cloud for the third count. His sentences are stayed for five years. Week must serve 112 days in the Beltrami County Jail and has been credited with 112 days time served. He has been placed on five years supervised probation and must pay a $750 fine for each charge which may be done through community service. Week has been ordered to pay $367 in restitution.

Robert Cori Llanas, 31, of Bemidji was sentenced for check forgery to 40 days in the Beltrami County Jail. Llanas has been placed on 10 years supervised probation and must pay a $1,000 fine.
