Court report: Sentencings for Mar. 3-10

The following cases were heard March 3 by Beltrami District Judge Shari R. Schluchter:

Robert James Tuttle, 33, of Cass Lake was sentenced for two counts of possessing pornographic work to 15 months in the Minnesota Correctional Facility in St. Cloud for the first count and 20 months in the Minnesota Correctional Facility in St. Cloud for the second count, both of which have been stayed for five years. Tuttle must serve 72 days in the Beltrami County Jail and has been credited for 48 days time served. He has been placed on supervised probation for five years and must pay a $1,050 in fines. Tuttle must successfully complete sex offender treatment and may not have contact with persons under the age of 18 until polygraph testing indicates he has not engaged in sexually abusive behavior toward children.

The following cases were heard March 7 by Beltrami District Judge Shari R. Schluchter:

John Henry Belmont, 44, of St. Paul was sentenced for domestic assault to 90 days in the Beltrami County Jail of which 47 days are stayed for two years. Belmont must serve 43 days and has been placed on two years supervised probation. He must pay a $300 fine.

The following cases were heard March 10 by Beltrami District Judge Paul T. Benshoof:

Emily Jayne Marthaler, 34, of Blackduck was sentenced for theft to 30 days in the Beltrami County Jail. She has been credited for two days time served. Marthaler has been placed on five years supervised probation and must pay a $1,000 fine which may be done by way of sentence to serve.

Melvin Allen Himmelright, 54, of Bemidji was sentenced for third-degree DWI to 365 days in the Beltrami County Jail of which 305 days are stayed for six years. Himmelright must serve 60 days and has been credited for five days time served. He has been placed on supervised probation for six years, however after the first year, probation will be reduced to unsupervised. He must pay a $400 fine.

Barry Douglas Tischman, 42, of Bemidji was sentenced for felony theft to 30 days home electronic monitoring and placed on five years supervised probation upon successful completion of which shall result in a misdemeanor conviction. Tischman must pay a $100 fine.

Kari Lynn Cook, 32, of Bemidji was sentenced for felony financial transaction card fraud to 45 days in the Beltrami County Jail. Cook has been credited with 31 days time served and placed on five years supervised probation upon successful completion of which shall result in a misdemeanor conviction. Cook must pay a $1,000 fine.

Robin Larae Butcher, 18, of Cass Lake was sentenced for felony criminal vehicular homicide or operating a vehicle with negligence under the influence to 60 days in the Beltrami County Jail. She has been credited for five days time served and placed on four years supervised probation upon successful completion of which shall result in a misdemeanor conviction. Butcher must pay a $500 fine which may be done by way of community service.

Adrian Richard Dunn, 37, of Bemidji was sentenced for felony theft to 39 months in the Minnesota Correctional Facility in St. Cloud. Dunn has been credited for 209 days time served. He must pay a $50 fine.

Michael Leon Garbow, 24, of Bemidji was sentenced for felony third-degree assault to 12 months and one day in the Minnesota Correctional Facility in St. Cloud which has been stayed for five years. Garbow must serve 189 days in the Beltrami County Jail and has been credited for 127 days time served. He has been placed on five years supervised probation and must pay a $1,000 fine which may be done by way of community service.

Joshua Alan Krogseng, 29, of Kelliher was sentenced for domestic assault to 365 days in the Beltrami County Jail of which 335 days are stayed for two years. Krogseng must serve 30 days and has been credited for 20 days time served. He has been placed on two years supervised probation and must pay a $500 fine which may be done by way of community service.

Jeremy Edward Pierce, 35, of Bemidji was sentenced for two counts of malicious punishment of a child to 365 days in the Beltrami County Jail of which 305 days are stayed for two years on the first count and 365 days are stayed for two years on the second count. Pierce must serve 60 days and complete the Batterer’s Intervention Program. He has been placed on two years supervised probation and must pay a $1,000 in fines which may be done by way of community service.

Ronald Eugene Brown, Jr., 46, of Bemidji was sentenced for fifth-degree possession of methamphetamine to 12 months and one day in the Minnesota Correctional Facility in St. Cloud which has been stayed for 10 years. Brown must serve 180 days in the Beltrami County Jail and has been credited for 30 days time served. He may serve his sentence in blocks of time and will be granted furlough for treatment. Brown has been placed on 10 years supervised probation and must pay a $1,000 fine which may be done by way of community service.
