Court report: Sentencings Dec. 20 to Jan. 7

The following cases were heard Dec. 20 by Beltrami District Judge Paul T. Benshoof:

Lee Lynn Neadeau, 26, of Red Lake was sentenced for giving peace officer a false name to 365 days in the Beltrami County Jail of which 355 days have been stayed for two years. Neadeau must serve 10 days. He has been placed on two years court probation and must pay a $300 fine.

The following cases were heard Dec. 30 by Beltrami District Judge Shari R. Schluchter:

Christopher Damon Franks, 41, of Brooklyn Center was sentenced for fifth-degree possession of marijuana with intent to distribute to 12 months and one day in the Minnesota Correctional Facility in St. Cloud which has been stayed for 10 years. Franks must serve 180 days in the Beltrami County Jail and may do so on Sentence to Serve, if eligible. Franks has been credited for 32 days time served. He has been placed on 10 years supervised probation and must pay a $1,000 fine.

Robert Leonhard Chute, 27, of Thief River Falls was sentenced for fifth-degree possession of heroin to 19 months in the Minnesota Correctional Facility in St. Cloud which is stayed for five years. Chute must serve 180 days in the Beltrami County Jail and has been credited for 40 days time served. He has been placed on five years supervised probation and must pay a $1,000 fine.

The following cases were heard Jan. 2 by Beltrami District Judge Shari R. Schluchter:

George Arthur Hoyt, 58, of Bemidji was sentenced for third-degree possession of methamphetamine/amphetamine to 33 months in the Minnesota Correctional Facility in St. Cloud. He has been credited for 76 days time served. A $50 fine has been stayed. Hoyt was sentenced concurrently for second degree sale of methamphetamine/amphetamine to 69 months in the Minnesota Correctional Facility in St. Cloud and credited for 76 days time served. A $50 fine has been stayed.

Mitchel Lawrence Fay, 27, of Bemidji was sentenced for second-degree DWI to 365 days in the Beltrami County Jail of which 275 days are stayed for four years. Fay must serve 90 days and may do so on work release or Sentence to Serve if eligible. He has been credited for 24 days time served and has been granted furloughs to attend the Steps to Freedom Program. Fay has been placed on four years court probation and must pay a $500 fine.

The following cases were heard Jan. 3 by Beltrami District Judge Shari R. Schluchter:

Jesse Allen Smith, 33, of Blackduck has been sentenced for fourth-degree assault of a peace officer to 45 days in the Beltrami County Jail of which he may serve on Sentence to Serve if eligible and has been credited for four days time served. Smith will be granted furloughs for participation in the Batterer’s Intervention Program and Steps to Freedom. Smith has been placed on five years supervised probation and must pay a $1,000 fine. Smith was also sentenced for domestic assault to 90 days in the Beltrami County Jail of which 86 days are stayed for two years. He is credited for four days time served and has been placed on two years supervised probation.

The following cases were heard Jan. 6 by Beltrami District Judge Paul T. Benshoof:

Brandon James Shaugobay, 27, of Minneapolis was sentenced for giving peace officer a false name to 365 days in the Beltrami County Jail of which 323 days are stayed for two years. Shaugobay must serve 42 days and has been given credit for 28 days time served. He has been placed on two years court probation and must pay a $50 fine.

Jackson Charles Hughes, 19, of Bemidji was sentenced for fifth-degree drug possession of Hydrocodone to 30 days in the Beltrami County Jail. Hughes must serve 30 days and may do so on work release if eligible. He has been credited for two days time served. Hughes has been placed on five years supervised probation.

Ian Edwin Odegaard, 23, of Bemidji was sentenced for third-degree DWI to 365 days in the Beltrami County Jail of which 335 days are stayed for three years. Odegaard must serve 30 days and may do so on work release if eligible. He has been credited for two days time served. Odegaard has been placed on three years court probation and must pay a $750 fine.

Bryan Louis Porter, 51, of Nett Lake was sentenced for first-degree DWI to 60 months in the Minnesota Correctional Facility in St. Cloud. Porter has been credited for 212 days time served. Conditional release after confinement has been set at five years. Porter must pay a $50 fine.

The following case was heard Jan.7 by Beltrami District Judge Shari R. Schluchter:

Gregory Walter Larson, 24, of Bemidji was sentenced for third-degree DWI to 365 days in the Beltrami County Jail of which 355 days are stayed for three years. Larson must serve 10 days and has been credited for four days time served. He has been placed on three years court probation and must pay a $50 fine.
