Court report: Sentencings for Dec. 13 and 16

The following cases were heard Dec. 13 by Beltrami District Judge Shari R. Schluchter:

Shanon Anelle Erickson, 37, of Bemidji was sentenced for theft to 90 days in the Beltrami County Jail of which 68 days are stayed for one year. She must serve 22 days and was placed on one year supervised probation. Erickson must pay a $50 fine. Erickson was also sentenced to 22 days in the Beltrami County Jail for fifth-degree possession of methamphetamine. She has been placed on five years supervised probation upon successful completion of which shall result in dismissal of the drug charge.

The following cases were heard Dec. 16 by Beltrami District Judge Paul T. Benshoof:

Michael Fredric Washenberger, 49, of Kelliher was sentenced for first-degree felony burglary possessing a dangerous weapon to 48 months in the Minnesota Correctional Facility in St. Cloud which is stayed for 20 years. Washenberger must serve 305 days in the Beltrami County Jail and has been credited for 203 days time served. He has been placed on 20 years supervised probation and must pay a $1,000 fine. Washenberger was also sentenced for second-degree DWI to 365 days in the Beltrami County Jail which is stayed for six years. He has been placed on six years supervised probation and must pay a $500 fine which can be completed through community service.

Wiley Nash Tschida, 20, of Bemidji was sentenced for theft of motor vehicle to 15 months in the Minnesota Correctional Facility in St. Cloud which is stayed for five years. He must serve 99 days in the Beltrami County Jail and has been credited for 66 days time served. Tschida has been placed on five years supervised probation and must pay a $1,000 fine.

Gavin Cory Spilman, 20, of LaPorte was sentenced for knowingly violating predatory offender registration or providing false information to 16 months in the Minnesota Correctional Facility in St. Cloud and has been credited for 77 days time served. Spilman must also pay a $50 fine.

Joel David Burdick, 28, of Bemidji was sentenced for second-degree felony burglary to 38 months in the Minnesota Correctional Facility in St. Cloud and has been credited for 96 days time served. Burdick must pay a $50 fine. Burdick was also sentenced for third-degree felony sale of narcotics to 33 months in the Minnesota State Correctional Facility in St. Cloud of which he has been credited for 120 days time served. Burdick must pay a $50 fine for this crime as well. Additionally, Burdick was sentenced for fifth-degree felony drug possession to 15 months in the Minnesota State Correctional Facility in St. Cloud of which he is credited for 115 days time served. Another $50 fine must be paid for this charge.

Dennis Dowayne Tolbert, Jr., 47, of Hines was sentenced for third-degree DWI to 365 days in the Beltrami County Jail of which 305 days are stayed for four years. Tolbert must serve 60 days and may do so on work release if eligible. He has been credited for 22 days time served. Tolbert was placed on four years court probation and must pay a $500 fine.

Olaf Kristen Olander, 35, of Bemidji was sentenced for felony terroristic threats to 18 months in the Minnesota Correctional Facility in St. Cloud which is stayed for five years. Olander must serve 60 days in the Beltrami County Jail and may do so on work release if eligible. Olander may pay a $1,000 fine by way of Sentence to Serve. He has been placed on five years supervised probation. Olander was also sentenced for theft to 60 days in the Beltrami County Jail and may do so on work release if eligible. He has been credited for 16 days time served.

Gerald Allan Knapp, 40, of Buxton, N.D., was sentenced for second-degree DWI to 365 days in the Beltrami County Jail of which 275 days are stayed for six years. He must serve 90 days and may do so on work release if eligible. Knapp has been placed on six years supervised probation and must pay a $750 fine and may do so by way of community service.
