Bemidji man pleads not guilty in Super Bowl sex assault case

BEMIDJI -- A Bemidji man plead not guilty Tuesday in Beltrami County Court to felony third-degree criminal sexual conduct charges.

David Earl Neumann, 24, was arrested in February after a woman reported a sexual assault following a Super Bowl party. According to court documents, Neumann should have known his victim was mentally impaired, mentally incompetent or physically helpless.

Neumann was arrested Feb. 3 at his apartment on Washington Avenue South. Officers collected evidence from the apartment including a belt buckle that was confirmed to be also a knife, which the victim told law enforcement caused her to be scared during the assault.

According to court documents, Neumann said he had been drinking before the game and “blacked out on the couch.” Although he indicated he knew why officers were at his apartment, Neumann denied having sex with anyone.

Third-degree criminal sexual conduct carries a maximum penalty of 15 years in prison and a $30,000 fine. Neumann is scheduled for a pretrial hearing on Oct. 14 in Beltrami County Court.
