Area court report for June 9

The following cases were heard by Beltrami County District Judge Paul Benshoof on May 28:

-- Michael Richard Iceman, 47, of Red Lake, was sentenced for gross misdemeanor third-degree DWI.

He was sentenced to one year in jail, 305 days of which are stayed for four years. He may serve 60 days on work release, nine days of which have been credited already served.

He was placed on probation for four years and must pay a $500 fine and $435 in fees.

-- Ricky Lee Lidel, 58, of Bemidji, was sentenced for felony domestic assault.

He was sentenced to 21 months in prison, which is stayed for five years.

He was sentenced to 112 days in jail, with 75 days credited for time already served.

He was placed on supervised probation for five years, and must attend domestic abuse counseling, have no contact with the victime and stay away from the victim’s residence. He must pay a $1,000 fine and $160 in fees.

-- Kevin Charles Hart, 68, of Red Lake, was sentenced for gross misdemeanor driving after cancellation inimical to public safety.

He was sentenced to one year in jail, 275 days of which are stayed for two years. He is currently serving a jail sentence in Clearwater County.

He was placed on probation for two years. He must pay $300 find and $80 in fees.

-- William Henry Magnuson, 64, of Hines, was sentenced for gross misdemeanor drivers’ license restriction violations.

He was sentenced to one year in jail, 355 days of which are stayed for two years.

He was placed on probation for two years. He must pay a $300 fine and $160 in fees.

-- Chad Michael Smith, 31, of Benedict, was sentenced for gross misdemeanor second-degree DWI.

He was sentenced to one year in jail, 335 days of which are stayed for three years. He was given credit for three days time already served.

He was placed on probation for three years. He must pay a $500 fine and $360 in fees.

The following cases were heard by Beltrami County District Judge John Melbye on May 28:

-- Brandon Frank Johnson, 23, of Redby, was sentenced for felony domestic assault by strangulation.

He was sentenced to 45 days in jail and is credited 45 days. Restitution has been reserved, and the state has 30 days to file for a certificate of restitution.

He was placed on supervised probation for four years, and must attend domestic abuse counseling, mental health counseling and must have no contact with the victim or their family. He must pay a $1,000 fine and $160 in fees.

-- Joey Jay Lee, 37, of Blackduck, was sentenced for felony fifth-degree drug sale.

He was sentenced to 30 days in jail, which he may serve on work release if eligible. He was credited for two days already served.

He was placed on probation for five years. Successful completion of probation will result in a misdemeanor conviction. He must pay a $1,500 fine, $750 of which is stayed until May 28, 2018. He must pay $85 in fees.

-- Andrew Arthur Woods, 30, of Bemidji, was sentenced for two counts of fourth-degree assault of a peace officer.

For both counts, he was sentenced to prison for one year and a day, which was stayed for three years.

On the first count, he was sentenced to 90 days in jail. The amount credited for time already served was unavailable. He must pay a $100 fine with $160 in fees. Community service is granted for the fine. He must also pay a $701.97 restitution.

For both counts, $500 of the fine is stayed if he completes treatment and has no violations for one year.

He was placed on supervised probation for three years on both counts.

The following cases were heard by Beltrami County District Judge Shari Schluchter on June 3-4:

-- John Kevin Bilinski, 25, of Pennington, was sentenced for gross misdemeanor driving after cancellation inimical to public safety.

He was sentenced one year in jail, 363 days of which are stayed for two years. He was given credit for two days already served.

He was placed on probation for two years and must pay a $400 fine and $85 in fees.

-- Richard Glen Simmons, 27, of Faribault, was sentenced for felony violation of his predatory offender registration requirements.

He was sentenced to prison for 34 months, with 747 days credited for time already served. He must pay a $50 fine and $110 in fees.

-- Negonibenais Smith, 21, of Bemidji, was sentenced on two counts.

For gross misdemeanor obstructing the legal process, he was sentenced to one year in jail, 320 days of which are stayed for two years. The amount of time he has already served was not available.

He was placed on supervised probation for two years. He must pay a $250 fine and $85 in fees. Community service is granted for the fine.

-- Timmy Carl White, 54, of Laporte, was sentenced for gross misdemeanor second-degree DWI.

He was sentenced to one year in jail, 275 days of which are stayed for four years. He is to serve 90 days on work release, if eligible.

He was placed on probation for four years. He must pay a $1,000 fine with $110 in fees. Community service is granted for the fine.
